DECREE

DETAILED RULES FOR IMPLEMENTATION IN ELECTRONIC TRADING ON THE DIGITAL SIGNATURE AND AUTHENTICATION SERVICE DIGITAL SIGNATURE

Pursuant to the Law on organization of The government on 19 February 6, 2015;

Pursuant to the Law on electronic transactions, 29 September 11, 2005;

Pursuant to the Law on information technology, 29 October 6, 2006;

Pursuant to the Law on fees and charges, 25 march 11, 2015;

According to the proposal of The minister of information and Communications;

The government issued a Decree detailing the implementation of electronic transaction Law on digital signature and authentication service digital signature.

Chapter I: general provisions about Ln in electronic trading on digital signature

Article 1. Adjustment range

This decree details about digital signatures and digital certificates; the management, provision and use of digital signatures, digital certificates and authentication service digital signature.

Article 2. Applicable objects

This decree applies to agency organization, management, service provider of digital signature authentication; agencies, organizations and individuals use digital signatures, digital certificates and authentication service digital signatures in electronic transactions.

Article 3. Interpretation of terms

In this Decree, the terms below are construed as follows:

“Key” is a string of binary numbers (0 and 1) used in the system code.
“System cryptography asymmetric” is code system has the ability to create key pairs, including the secret key and public key.

“Digital signature” is a form of electronic signature is generated by the transformations a message data systems use asymmetric cryptography, according to which, people get the message to the original data and the public key of the signer can be determined exactly:
a) The transformation mentioned above is generated using the correct secret key corresponding to the public key in the same key pair;
b) the integrity of The content of the message data since the implementation of the transformation mentioned above.
“Digital certificate” is a form of stock e-mail of organization that provides services for digital signature certificate issued to provide information identifier for the public key of an agency, organization, individual, from which confirm the agencies, organizations and individuals who sign the digital signature using the secret key respectively.

Article 6. Certified mail number of agencies, organizations and authorities of agencies, organizations and

Article 8. Legal validity of digital signatures

Article 9. Conditions to ensure safety for digital signature

Article 11. Operating conditions

Article 14. Profile licensed

Article 15. Verifying and licensing

In a period of 50 days from the date of receiving invalid licence, the Ministry of information and Communications, and coordinate with the Ministry of Public security, people's army of vietnam and the ministry of industry relevant verifying and licensed for business in the case of business meet the licensing conditions in Article 13 of this Decree. Case the license is lost or damaged, enterprises have to submit application for re-grant of license Form no. 03 in appendix issued together with this Decree, stating the reason to the Ministry of information and Communications. Within 07 working days from the date of receipt of the proposal, the Ministry of information and Communications review and re-issuance of permits for business.

Term of license re-issuance of lost or damaged is the remaining term of the license was issued.

To ensure the continuity of the provision of services, businesses have the desire to continue to provide services to filing for re-grant of license for a minimum of 90 days before the license expires. Profile re-grant of license due to expire, including:

In a period of 30 days from the date of receipt and valid dossier, the Ministry of information and Communications, and coordinate with the Ministry of Public security, people's army of vietnam and the Ministry of industry relevant verifying and checking the business meet the licensing conditions on reality and re-issuance of permits for businesses in the business case meets all the licensing conditions, the Ministry of information and Communications re-issuance of permits for business. Term of license re-issuance due to expiration is 10 years.

Article 17. Temporary suspension of license, pause certificate number

a) Providing services with content recorded on the license;

Article 18. Revoked license

Article 26. Renew digital certificates for subscribers

At least 30 days before the expiration date of the digital certificate, the subscriber may request to renew the digital certificate.
After receiving a request for renewal of subscription, the organization provides service authenticated by the signature of the public are obliged to complete the procedure to renew the digital certificate before it expires.
Case change the public key on the digital certificate is renewed, the subscriber must ask clearly; the key generation, key distribution and publication of the digital certificate is renewed done according to the provisions of Articles 24 and 25 of this Decree.

Article 27. Change key pair for subscribers

In case subscriber wishing to change the key pair, the subscriber must submit proposed changes to the key pair. The key generation, key distribution and publication of the digital certificate with the public key new made according to the provisions of Articles 24 and 25 of this Decree.

Article 28. Pause, recovery certificate number of subscribers

The digital certificate of the subscription is paused in the following cases:
a) When the subscriber requests in writing and this requirement has been organized to provide services for digital signature certificate, public verification is correct;

Article 30. Service level timestamp

c) didn't fix the conditions for suspension specified in paragraph 2 of Article 38 hereof, after a period of pause determined by the state agency;
d) The organization does not want to continue to provide services.

Article 39. The rights and obligations of organizations and service provider of digital signature authentication specialized

For organizations that provide services for digital signature certificate abroad are the digital certificate is recognized in Vietnam
a) to establish and operate legally in the country in which the organization provides services for digital signature certificate of foreign registration activities;

Article 47. Profile licensed to use the digital certificate in Viet Nam

Article 82. Transitional provisions

Article 83. Effect
